1.1 Conference – ABBYY Vantage Broadcast held on 12-14 October 2021 on the Platform.
1.2 Organizer – ABBYY Development Inc., 874 Walker Road, Suite C, City of Dover, DE, 19904, County of Kent.
1.3 Participant– representative of a legal entity or a natural person of full age who has full capacity to perform acts in law, as well as representatives of legal persons and organizational units that do not have legal personality, but which are able to acquire rights and assume obligations in their own name, and which used the System to correctly register for the Conference, until 12 October 2021 (Preliminary date).
1.4 Participation fee - The ticket price determined by the Organizer that must be paid by Participant by purchasing a ticket, to confirm his participation in the Conference.
1.5 Platform - an Internet application Big Marker, owned and operated by the third party – [BigMarker.com LLC having its registered seat in 223 West Erie St, Suite 4E, Chicago, IL 60654б which enables the supporting of Conference for Participant.
2.1 The provisions contained herein constitute an integral part of applying for participation in the Conference and are applicable to all Participants.
2.2 To participate in the Conference, Participant must register for the Conference, which can be done exclusively via an on-line form in the Organizer’s website. The Participant will receive the link for connection to the Conference.
2.3 The number of Conference places is limited. Participants will be enlisted on a “first come, first serve” basis. The Organizer reserves the right to reject registration requests when the limit is reached.
2.4 The Conference shall be open for registration from 16 September 2021 until the last available place has been booked, but in any case, no longer than until 14 October 2021.
2.5 Participation in the Conference shall be free of charge.
2.6 The Organizer reserves the rights to prepare and to modify the agenda of the Conference and/or the list of speakers by the Organizer’s sole discretion. The Organizer shall not be held liable in any way for damages vis-à-vis the Participant in such event.
2.7 During the Conference, the Participant shall follow any instructions that may be given by the Organizer and shall refrain from recording of the keynote speech (in audio, video and photo formats, or any combination thereof).
2.8 Should a Participant be found to be in breach of this Terms and Conditions, any legal rights of the Organizer, or generally accepted norms of behavior, the Organizer reserves a right to refuse the Participant the right to participate in the Conference and to disconnect him or her to Conference with no reimbursement.
2.9 The Organizer reserves a right to alter the Conference date or to cancel the Conference by his sole discretion without any penalty, compensation of losses and any other obligations before the Participant.
2.10 The Participant has a right to cancel his participation anytime for any reason free of any charge.
3.1 By giving the Organizer and its affiliates the Participant’s personal information, he/she expressly consent to collection, use and disclosure of personal information as described in Privacy notice. The Organizer will process the Participants' personal information for the purpose of their participation in the Conference (e.g., to send confirmation of participation and further Conference information). The Organizer and its affiliates will also send marketing communications to the Participant email address provided that we have legal basis for this activity (e.g., consent). You may always unsubscribe from marketing communication at any time in the future by clicking on the unsubscribe link in any email received from the Organizer and its affiliates.
3.2 You should be aware that during the Conference, the Organizer (or its vendor) may arrange video or audio connection in the course of the Conference sessions. By participating in the Conference, the Participant gives his/her implicit permission for the participation in the video or audio sessions (if such option is enabled by the participant), use an/or dissemination by the Organizer and parties related to it during the video or audio sessions. This permission means specifically that photo, video, and audio recordings taken during the Conference may be placed on the Conference website or another website managed by the Organizer or its affiliates, as well as used in marketing materials, including by dissemination in audio or video formats. The Participant hereby waves any claims (existing or future), including for compensation from the Organizer and its affiliates for such use of their image, voice or expression for the purposes defined hereunder.
3.3 By providing the Organizer and its affiliates with his/her personal information, the Participant expressly consents to share this information with Conference sponsoring companies for promotional (e.g., networking and meetings) and marketing purposes (advertising their products and services to you). The Participant has the right to object to such disclosure. If you do not want to share your data with Conference sponsoring companies, please contact us prior to the Conference at conferences_usa@abbyy.com. You may also contact Conference sponsoring companies directly and opt-out of marketing communication (subject to their separate Privacy Policy/Notice).
3.4 No intellectual property (e.g., trademark, service mark, copyright, graphic etc.) of the Participant will be used by Organizer without Participant’s explicit consent. Organizer will approach Participant separately to obtain such consent if required.
3.5 The Organizer will maintain ownership and copyright of any materials, created by or in favor of the Organizer, as well as created in process of the Conference, or bounded with it, including video, and audio recordings.
4.1. In any case the Organizer shall not be responsible for covering any expenses of the Participant made in association with the Conference.
4.2. The Organizer shall not be held liable in any way for using the Platform by the Participant, the security of the Participant’s systems or equipment, well as for the Internet connection and operation of the Platform and/or any other technical failures.
4.3. The Organizer shall not be liable for any direct or indirect loss, damage, or delay caused by the Conference.
4.4. Any disputes arising in relation to the Conference participation shall be decided by courts with jurisdiction for the Organizer.
4.5. Any claim may only be asserted by the Participant within one (1) year of the date upon which the cause of action arose.
4.6. Any complaints by the Participant to the Organizer as regards the non-compliance of the services provided to the Participant with the terms of this Agreement shall be recognized only if submitted during the time of the Conference and if made in writing and signed by the duly authorized representatives of both parties. No claims by the Participant shall be recognized by the Organizer if submitted after the end of the Conference.
4.7. In no event will the total liability of the Organizer exceed the amount to the sum of fifty United States dollars (U.S. $50).
4.8. The Participant shall indemnify, defend and hold harmless Organizer and its affiliates, and each of their respective officers, directors, agents and employees from and against any and all claims of loss, liability, costs or expenses (including reasonable attorneys' fees) made against or sustained by them based on, arising out of or relating to (i) any third party claim and dispute arising out of or relating to a breach of any representation, warranty or covenant of the Participant hereunder; (ii) the information provided by the Participant to the Organizer; or (iii) the participation of the Participant in the Conference.
4.9. Force Majeure. In the event that the Organizer is prevented from carrying out its obligations as a result of any cause beyond its control, including but not limited to acts of God, war, acts of terrorism, disease or pandemic, virus propagation, airline flight cancellations, strikes, lock-outs, flood, or failure of third parties to deliver goods or services, the Organizer shall be relieved of its obligations and liabilities for as long as (i) fulfilment is prevented, and/or (ii) performance becomes impossible.
4.10. DISCLAIMERS. THE ORGANIZER MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE OR NON-INFRINGEMENT OR THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE ORGANIZER’S WEBSITE OR SYSTEM, ANY PRODUCTS, SERVICES OR INFORMATION PROVIDED BY ORGANIZER, THE ACCURACY OF, OR RESULTS TO BE OBTAINED BY, USE OF ORGANIZER PRODUCTS OR SERVICES, THE PLACEMENT OF PARTICIPANT CONTENT, OR SECURITY OF THE SYSTEM OR SERVICES.
4.11. Miscellaneous. If any term of this Terms and Conditions is declared invalid or unenforceable, the remainder continues in full force and effect. The Organizer reserves the right to make changes in this Terms and Conditions.
